O Artigo 216 da Constituição conceitua patrimônio cultural como sendo os bens “de natureza material e imaterial, tomados individualmente ou em conjunto, portadores de referência à identidade, à ação, à memória dos diferentes grupos formadores da sociedade brasileira”. O patrimônio cultural é assim, o conjunto de manifestações, realizações e representações de um povo. Ele faz parte de nosso cotidiano, forma as identidades e determina os valores de uma sociedade. É ele que nos faz ser o que somos. O advogado, escritor e jornalista mineiro foi o grande responsável pela criação do Serviço de Patrimônio Histórico e Artístico Nacional (SPHAN), hoje Instituto do Patrimônio Histórico e Artístico Nacional (Iphan) e em sua homenagem é comemorado hoje, dia 17 de agosto, o dia do Patrimônio Cultural. O legado de Rodrigo Melo Franco de Andrade se confunde com a trajetória da preservação do patrimônio cultural no país, a ponto de simboliza-la. Ao termino de sua gestão, a instituição estava consolidada, reconhecida no país e internacionalmente pelo êxito de suas ações e realizações voltadas para a preservação do patrimônio cultural.
