Iwuchukwu Amara Tochi, a young Nigerian footballer, was hanged in #Singapore in 2007, when he was 21 years old. Tochi was arrested in Changi Airport in 2004, when he was 18 years old. He was later charged with importing not less than 727.02g of #heroin into the country. Under the presumption clause in S18 of the Misuse of #Drugs Act, because he was in possession of the drugs, he was presumed to have known the nature of the drugs. At that time, Tochi had originally wanted to go to #Dubai to play #football, but was unable to. He met a man named Smith who offered to get him to Singapore, and asked him to deliver something to another man, Marshall, who would meet him in the transit area of Changi Airport. But Marshall missed his flight, so Tochi had to wait in the transit area. When he tried to check into the transit hotel, the supervisor called the airport police because hed already been in the transit area for some time. When she informed him that the police had been called, he waited for them to arrive. The police searched his things and found capsules that Tochi claimed were herbs. He even swallowed one, and had to be sent to hospital to purge the capsule. It was later found that the capsules were heroin. At trial, his defence counsel argued that Tochi hadnt known he was carrying heroin: if he had, why did he wait for the police to arrive, why didnt he try to hide what he was carrying, and why did he even swallow a capsule? The judge agreed that there was no direct evidence that Tochi knew he was carrying heroin. But he argued that Tochi should have suspected something was going on, since he was being offered US$2,000 to make the delivery. He also said that Tochi was not a simple sheltered boy fresh out of his village. The judge found that Tochi had been wilfully blind, and that even if he really hadnt known the capsules were heroin, ignorance was not a defence because he should have suspected something was up, and should have checked. Tochi was sentenced to the mandatory #deathpenalty. His appeal was dismissed, and President S.R. Nathan rejected his clemency plea. He was hanged in Changi Prison on 26 January 2007. #RIP #humanrights - @kixes on Instagram
